Terazidere Mah. Sinan Sk. No: 11/10 Başrampaşa – Istanbul Meriçler Deri Ürünleri San. Tic. Ltd. Şti. company (“Balantion”), and the use of the Site by Users and Members is subject to the following terms and conditions.

Balantion reserves the right to modify the services, products, intellectual and artistic works, any information and data provided on the Site, including the Terms of Use and Membership Agreement, to suspend Site publication, to completely stop Site publication, and to reorganize the Site in the broadest scope without any prior notice or warning. Such changes made by Balantion take effect upon their publication on the Site, and these changes are deemed accepted by the user’s entry to the Site, any form of access, or use of the Site.

Real or legal persons who completely and accurately fill out the membership form to the Site and whose memberships are deemed appropriate and approved by Balantion are accepted as “Members“. You must be over 18 years old for membership.

All members and visitors (“User“) who log into the Site, visit the Site, use it in any way, access the Site and/or connect in any other way, hereby declare, accept and undertake in advance that they will comply with the Website Terms and Membership Agreement set forth on this page. The aforementioned “User” expression refers to any person who has logged into the Site by member login or in any way, uses, examines the Site, or has connected to the Site through any communication device (mobile phone, computer, etc.) or has engaged or is engaging in electronic data exchange through the Site.

Service Content and Subject of the Agreement

The service that Balantion will provide through the Site (“Service”) is the delivery of products offered for sale on Balantion’s online shopping site to the customer by the cargo company, undamaged and flawless, within the committed time period, provided that Balantion’s stock status is suitable after the price is paid by the member. This membership agreement (“Agreement”) has been prepared between Balantion and the Member to determine the conditions for the Member to benefit from the Services offered by Balantion on the Site, the use of the Site, the determination of membership terms and rules, and the determination of the member’s terms of benefit.

Rights and Obligations of the Parties:

Balantion continuously checks the accuracy and currency of the information available on the Site. However, Members and Users should be aware that this information may not always be current.

Balantion has the right to cancel the member’s membership and delete files, documents and information belonging to the customer without showing any reason, if it wishes. The Member accepts this action in advance. In this case, Balantion has no responsibility.

The Member has agreed not to access or use other internet users’ software and data without permission. Otherwise, all legal and criminal responsibilities arising from this belong entirely to the member.

Balantion reserves the right to correct, remove or modify the Services of this Site and/or any page at any time and without prior notice due to force majeure or entirely at its own discretion.

Balantion’s sales are limited to stocks. It may not deliver products that are not in stock on the Site, may cancel the order and refund the order amount to the customer’s account. The display of products in the virtual store does not necessarily mean that these products are in stock at the Site or Balantion stores. The authority to change the price and product feature information of products offered for sale on the Site belongs exclusively to Balantion. In case of errors in price and product feature information, Balantion may deliver the product by correcting the error or cancel the order and refund the order amount to the customer account, provided that it has the exclusive right to choose.

Users and Members cannot use the Site in any way that disrupts public order, is contrary to general morality, disturbs and harasses others, for illegal purposes, or in a way that violates others’ intellectual and copyright rights. All kinds of expressions, comments, writings, pictures, visuals and all other information and documents that Users and Members will add to the Site must be in content and form that comply with general morality and decency and relevant national and international legislation. In addition, members cannot engage in activities and transactions that prevent or make it difficult for others to use services (spam, virus, trojan horse, etc.). Balantion will report such a violation to the relevant law enforcement authorities and will cooperate with them by disclosing the Member’s identity, and in case of a violation, the Member’s right to use the site will end. In such a case, Balantion has no legal or criminal responsibility for any and all direct and indirect damage, loss, harm and/or losses that the User, Member or other third parties may suffer for any reason. Users hereby accept, declare and undertake in advance that they will not make any claims or demands from Balantion due to the aforementioned damages.

The Member cannot give the password given to them to other persons or organizations; the Member’s right to use the said password belongs personally to them. The email address given during registration is specific to the Member and has the possibility to create only one membership. Balantion reserves all compensation and other claim rights arising from such unauthorized use against all responsibilities that may arise for this reason and all claims and demands that may be made against Balantion by third parties or authorized authorities.

The Member declares and undertakes that the personal and other information they provided when becoming a member of the Site is true before the law, that Balantion has no legal responsibility for damages arising from providing false membership information, and that they will compensate all damages that Balantion will suffer due to the falsity of this information exactly and immediately. The Member accepts that in case of providing false information, the Agreement can be terminated unilaterally by Balantion without any need for notice or warning. The accuracy and completeness of the information provided by the member during membership application is not Balantion’s responsibility.

The Intellectual Property Rights of all content presented on the Site (products, information, texts, images, trademarks, icons, visual or audio images, video clips, designs, catalogs, files, lists, data, codes, slogans and other marks, page layout, etc. on the site) belong to Balantion. Balantion reserves all such rights. Only content provided for the Member’s or User’s personal use can be stored, printed and viewed. The Member cannot publish, process, distribute or reproduce in any other way and in any format any content appearing on this Site or copies of the content, nor can they use any such content in connection with a business or commercial enterprise.

Sales Conditions and Formation of the Agreement

By placing an order, you agree to purchase the product under and subject to the following terms and conditions. All orders require the product to be available and the order amount to be confirmed. Distribution times vary depending on whether the product is available, and any guarantee or statement regarding delivery time is limited to Turkey and may be subject to delays due to reasons beyond our responsibility such as postal delays or force majeure. If Balantion cannot deliver the contract product within the specified time due to force majeure or extraordinary circumstances such as adverse weather conditions that prevent transportation or interruption of transportation, it will notify the User or Member of the situation. In this case, the User or Member can exercise one of the rights to cancel the order, replace the contract product with its equivalent if available, and/or postpone the delivery time until the preventing situation is eliminated. If the User or Member cancels the order, the amount paid will be paid to them in cash and in full within 10 days.

To make an agreement with Balantion, you must be over 18 years old and have a valid credit card or bank (debit) card issued by a bank we accept. You will be notified by email when your order is accepted. When placing an order, you undertake that all information you provide to us is accurate and complete, that you are the authorized user of the credit or bank (debit) card you used when creating the order, and that you have sufficient financial resources to cover the cost of the goods.

When you place an order, you will receive a confirmation email confirming that your order has been received. This email only confirms that your order has reached us and does not mean that your order has been accepted. No agreement will be formed between you and us until we send you an email confirming that the products you ordered have been shipped. Only the products listed in the confirmation email sent when the products are shipped will be included in the agreement.

Resolution of Disputes:
Turkish legislation in force will be applied to disputes arising from this Agreement, and T.C. Istanbul Anatolian Central Courts and Execution Directorates will be authorized to resolve all kinds of disputes that may arise from the implementation of this Agreement.

Validity and Termination of the Agreement:

The Member’s membership registration means that the member has read all the articles in the Agreement and accepts all the articles in the Agreement. This Agreement was concluded at the moment the Member became a member and entered into force mutually. This Agreement will remain in force until the Member cancels their membership or the membership is canceled by Balantion.

The User declares, accepts and guarantees that they have read, understood and accepted all the articles in this Agreement and confirms the accuracy of the information they provided about themselves.
